Report: BP says oil spill trial could last years

(AP)? LONDON ? BP chief executive Bob Dudley says the trial over the 2010 oil spill in the Gulf of Mexico could last for years.

Dudley said BP is preparing to be in court for several years, but hopes it can reach agreements on some parts of the case which begins Monday in New Orleans.

Dudley, who took control of BP in 2012 after former chief executive Tony Hayward resigned amid criticism over the way he had handled the oil spill, told the Sunday Telegraph newspaper that the company has prepared for the possibility that the trial will continue until 2014.

The company has set aside $40 billion to deal with fines and associated costs of the disaster.

From the Archives: Ex Omnia Conchis - Darwin and His Beloved Barnacles

***This post was a brief write up of a?Darwin Day presentation I gave at Duke Marine Lab in 2010.***

Barnacles held an immense fascination for Darwin. It was through some rather chance events that he ended up being the world expert on this fascinating group. He created 4 volumes of masterpieces devoted to all available living and fossil barnacles. I hope to show that indeed his work with the barnacle did indeed contribute to solidifying his thoughts on transmutation and improving his understanding of what will eventually become his greatest contribution to science.

Erasmus Darwin

Charles Darwin?s grandfather Erasmus (at right) was an eccentric physician noted for racey poetry and the author of?Zoonomia in 1794, a text that presaged the evolutionary works of even Lamarck. Erasmus? eccentricism appeared to permeate his whole life.?Ex omnia conchis ? all from shells ? was transcribed everywhere according to Rebecca Stott, author of?Darwin and the Barnacle. Curiously, the crest of the Darwin-Wedgewood family (right) bears 3 shells. Erasmus? inspiration must have stemmed from a family history of love for the natural environment. Though Charles Darwin never would have known his grandfather ? Erasmus died in 1802, seven years before Charles was born ? the family crest and?ex omnia conchis surely foreshadowed his legacy.

Darwin started speculating on species during the?Beagle voyage, but many of his ideas were solidified in the years after the expedition and after much consultation with a wide variety of taxonomic experts. He was very close to publishing his theory of evolution by the 1840s and was keenly aware of the abuse given to Lamarck?s theories. In 1844, Robert Chambers anonymously published a book titled?Vestiges of the Natural History of Creation which was written in a style, and priced, for the lay person. It became very popular and laid his own theory for evolution built upon Lamarckian ideas.?Vestiges purported a linear chain of transmutation culminating in man ? more specifically, a white English man.

While popular with the laity, the academics and clergy who mentored Charles, and whose approval he often sought, were up in arms about the book and its rampant attacks against Natural Theology, the prevailing?modus operandi in the natural history community of the time. It was because of this that botanist John Hooker, a friend and confidant, wrote Darwin after reading a draft of his ?big species paper?:

?Do not think I meant to insinuate that you could not be a judge from not having worked out species, for your having collected with judgement is working out species: what I meant I still maintain, that to be able to handle the subject at all, one must have handled hundreds of species with a view to distinguishing them & that over a great part,?or brought from a great many parts,?of the globe.? ? Hooker in a letter to Darwin 14 September, 1845

This frightened Charles, as he was not inclined to disappoint or scientifically alienate himself from his beloved colleagues. While it is arguable that Hooker?s letter set back Darwin?s publication of his ideas, it encouraged him to intimately study several larger aspects of morphology that would inevitably aide him in cementing his theory of evolution by natural selection.

Mr. Arthrobalanus (=Cryptophialus).

Darwin had been working on a problematic barnacle collected during the?Beagle voyage since 1835 he? called ?Mr. Arthrobalanus? (left). He noticed ?[t]he thick shell of some of the individuals of the Concholepas Peruviana [sic] is?completely drilled by the cavities formed by this animal? (Zoology Notes). In essence, Charles discovered the first burrowing barnacle! A rare find indeed and one that would intoxicate him with crustaceous ecstasy. He intended to describe this small, parasitic barnacle rather quickly, but ?was led, for the sake of comparison, to examine the internal parts of as many genera as I could procure.? Beginning in 1846, barnacles would consume his family?s life for the following 8 years resulting in 4 volumes of living and fossil barnacles of all known types from around the world during that time. Charles? son Francis would famously ask of another child, ?where does you father do his barnacles??

It was not until 1830 that it was realized barnacles were crustaceans. Since they were shelled creatures, naturalists had considered them mollusks akin to mussels, snails and limpets. John Thompson followed the embryology and metamorphosis of barnacles and determined by their developmental characteristics that they were actually closely aligned to the crustaceans. Mollusks weren?t considered a metamorphosing species to Victorian naturalists.

The basic concept that Darwin wrapped his barnacle synthesis around ? and even more so later in his?Origin -?was Richard Owen?s homology concept, meaning that characters were derived from shared ancestry. Owen was a powerful colleague and former mentor of sorts to Charles. Darwin had much respect for him and tried to work within Owen?s ?archetype? framework, which was initially developed with vertebrates in mind. The archetype was a theoretical ancestor, a blueprint in the mind of the ?creator?. Owen did not necessarily believe it existed but nonetheless thought it was a useful construct from which to understand his homology framework. Darwin, working within the archetype framework for barnacles, was able to systematically classify everything and place Cirripedia correctly as a subclass of the Crustacea, confirming Thompson?s earlier embryological observations.

One of the more interesting challenges to Darwin?s classification of barnacles was the issue of small ?complimentary males?, as he called them. Not only did these dwarf males attach to the female, but some species had hermaphrodites with attached dwarf males as well! Because Charles was working within Owen?s homology paradigm, he viewed hermaphroditism as a major character in his barnacle classification and made some interesting, though erroneous, inferences. In his Victorian worldview, Darwin naturally saw the condition of having separate sexes as the most ?highly evolved? state, while rampant hermaphroditism must surely be the basal condition. But these curious parasitic dwarf males must be a transitional state between a hermaphroditic ancestor and the more ?dignified? separation of sexes.

?These parasites, I now can show, are supplemental males, the male organs in the hermaphrodite being unusually small, though perfect & containing zoosperms: so we have almost a polygamous animal, simple females alone being wanting. I never sh^d. have made this out, had not my species theory convinced me, that an hermaphrodite species must pass into a bisexual species by insensibly small stages, & here we have it, for the male organs in the hermaphrodite are beginning to fail, & independent males ready formed.? ? Hooker was absolutely correct in suggesting to Darwin that he become an expert of a species prior to openly speculating on the subject. His eight years of focused, in-depth taxonomic study made Darwin keenly aware of the variation existing in nature. The choice of taxa enabled him to view strange morphology and reproductive strategies that may not have been as obvious as it was among barnacles. More importantly, his approach using homology helped to formulate three central components to the?Origin: 1) shared ancestry of parts in related organisms, 2) loss of useless organs (i.e. abdominal segments and swimmerets in barnacles) and 3) transformation in function of homologous organs (i.e. thoracic limbs for walking into cirri for feeding).

Though Charles, like systemacists even today, had difficulty drawing the line between what is and what is not a species he was one of the first taxonomists to recognize the role of variation in studying species. Eight years spent studying variation and homology did indeed make him an expert in the ?species question?. It confirmed his transmutationist views, gave him credibility in the face of?Vestiges and the much contested views of Lamarck, and resulted in an award from his colleagues at the British Association for his extensive monographic work. These elements were important in securing the ?political capital? needed once he was ready to unveil his tome on the origin of species by natural selection.

When Cancer Cells Spread To The Lymph Nodes

The first place to which lung cancer cells migrate is the lymph nodes. The cells are delivered through the lymphatic system. In many cases, this does not necessarily constitute metastasis since the cells can migrate during the early stages of the disease. Once the cancer cells have reached the lymph nodes, however, they can spread further to other areas of the chest.This spread is rarely caught by doctors since it is often absent of symptoms. While the disease can spread to bone anywhere throughout the body, common sites include the upper legs, pelvis, and spine. The patient will experience pain, which worsens as the disease advances. It is common for people to mistake the pain for mild sports injuries, such as muscle strains.By the time lung cancer has reached the bone, it has progressed to the point that treatment focuses on relieving symptoms rather than curing the disease. Radiation therapy is usually the treatment option of choice. The patient will also receive medications to help minimize the pain.

According to security experts, the US law enforcement approach is to identify potential lone wolf plotters, usually through tip-offs or online activity, and then deploy squads of covert agents to glean details of the plot. If the suspected terrorist is seen to be seriously planning an attack, agents will scheme to assist in the attack to create a record that can be later used in court.

President Obama?s performance in head-to-head matchups with his Republican competitors, especially Mitt Romney, have dramatically improved in recent weeks. In a survey conducted by the Pew Research Center for People & the Press, Obama went from being tied with Romney in trial heats last fall to holding an eight-point lead in the fresh batch of data released this week. The turnaround was even faster in the New York Times/CBS News poll, which found Obama trailing Romney by two points in January and up by six this week. The reasons might not be immediately apparent.

Presidential approval has not seen huge gains since the end of last year: Gallup tracking data show Obama?s job approval rating very close to where it was in mid-October of 2011?and in mid-October of 2010 for that matter?dipping just under water-level in the mid-40s. There are a few surveys that show something closer to 50, but national approval figures may actually overstate the President?s position.? Michael Scherer recently illustrated the degree to which Obama?s approval ratings in key swing states lagged behind national trends in 2011, while worse unemployment numbers dogged those same core states. So how can we square those facts with what we?re seeing in the head-to-head polls?

For one, swing states may decide presidential elections, but their economic health does not. As George Washington political science professor John Sides explains:

First, Thomas Holbrook?found?that state-level economies?measured with unemployment or changes in real per capita income?had?no relationship?to presidential election outcomes in the states in 1960-84, once measures of the national economy were taken into account.? Second, Daniel Eisenberg and Jonathan Ketchum?s study of the 1972-2000 elections?also finds?that the national economy outweighs the effect of state and county economies.

In this context, Obama?s brighter general election prospects begin to make sense. Voters might not feel like he?s doing a much better job, but they are beginning to feel better about the direction of the country economically, a dynamic which favors the incumbent. Three-quarters of Americans still believe the economy is in bad shape, according to the NYT/CBS poll, but the remaining 23% who say things are good is the highest level since last spring. More importantly, the number of Americans who think the economy is improving?absolutes are less important in politics than a feeling of positive movement?has grown even faster: 34% in the same survey, up six percentage points in a month. Gallup data also show the highest economic confidence level in a year, and the crucial outlook number overtook appraisals of current conditions in December, a trendline that holds promise for the current occupants of the White House:

The second piece of this puzzle is Mitt Romney. Romney has long been the strongest general-election player in the GOP field, but the savage primary fight is beginning to take a toll. Romney?s unfavorability rating has reached its highest mark?49% in the Pew poll?since his debut on the national stage in 2007. The number of voters who perceived him as ?untrustworthy? leaped from 32% a month prior to 45% this week. The number of independents who said he was prepared to be President dropped 10 percentage points to 48%, and their candidate preference swung narrowly to Obama. Where Romney once out-performed the likes of Rick Santorum in these trial heats, the latest polls found only a one-point difference between the two.

It could all shift again.?The GOP race has taken plenty of hairpin turns already and when (or if) Romney secures his track to the nomination, there will be a period of calm in which he can work to restore his standing with independents or drag Obama?s numbers back down. Presidential candidates in years past have been scarred by primary scrapes only to appear unblemished for the general election. Economic confidence is still low, the recovery may darken again under the cloud of Europe and the President faces a daunting re-election task either way. But for this snapshot in time, a weakened Romney and a strengthened economy make for the best outlook Obama?s had in quite some time.

According to the Houston Chronicle, a group of Texas congressmen are still unhappy the Obama administration snubbed the home of the Johnson Spaceflight Center when it came to displaying a space shuttle orbiter.

The congressmen, led by Pete Olson, are demanding answers.

Why are the Texas congressmen unhappy?

The problem started in April, when NASA Administrator Charles Bolden announced the selection of the final resting places of the space shuttle orbiter fleet. Discovery went to the Smithsonian in Washington. Atlantis went to Kennedy Space Center in Florida. Endeavour went to the California Space Center. Enterprise, the drop test article that was never launched into space, went to the Intrepid Air and Space Museum in New York.

Houston, where the control center of all American space flights has resided since 1965, was snubbed, according to Texas politicians. Space Center Houston had planned to display a space shuttle orbiter next to the Saturn V, with a climate controlled enclosure.

A NASA Inspector General Report that failed to find undue political influence has not assuaged the outrage of Texans. Bolden changed the criteria for displaying a shuttle from the principle one being a historical relationship with the shuttle program to the location being a high-traffic area for tourists.

The New York Relocation

To add fuel to the fire, in September, New York officials decided to change the venue for the display of the Enterprise. Instead of an enclosure at a pier next to the Intrepid Air and Space Museum, Enterprise would be parked in a building to be built in a parking lot across the West Side Highway from the Intrepid on 12th Avenue. This move had the Texans crying bait and switch.

What do the Texas congressmen want?

The Texas congressmen are demanding documents. Along with members from Utah, Mississippi and Ohio, the congressmen want the Intrepid Museum's original design proposal, the minutes of a meeting that took place in April in which various display plans were discussed, and a report whether moving Enterprise to New York would cause damage to the shuttle's structure.

NASA's official position is it has no plans to re-evaluate the decision to display Enterprise in New York. NASA maintains New York's decision to display the shuttle across the highway from the Intrepid Museum is in compliance with obligations to the space agency.

US men to play 1st World Cup qualifier in Tampa

CHICAGO - The road to the 2014 World Cup in Rio de Janeiro begins in Florida.

U.S. Soccer announced Wednesday that Raymond James Stadium in Tampa will be the site of its first qualifier, June 8 against Antigua and Barbuda. It will be the first World Cup qualifier in Florida since November 1980, when the Americans beat Mexico 2-1 in Fort Lauderdale.

The Americans, trying to qualify for their seventh straight trip to soccer's championship, have never played Antigua and Barbuda.

"Our focus since last summer has been to prepare this team for World Cup qualifying, and we are thrilled that we can start the process in Tampa," U.S. coach Jurgen Klinsmann said. "It's critical that we start qualifying off on the right foot, so to be in a place where the team has had such great support is a huge positive for us. The players always talk about how great the surface is at Raymond James Stadium, so overall we think it is the ideal venue."

The U.S. is 3-2-1 in Tampa, including a 3-1 victory over Ecuador in 2007, when 31,547 fans saw Landon Donovan score a hat trick. Tampa also hosted the U.S. Under-23 team in qualifying for the 2008 Olympics, with the Americans going 2-0-1 against Cuba, Honduras and Panama.

The Americans also play at Guatemala in World Cup qualifying on June 12. After the summer break, the U.S. plays at Jamaica on Sept. 7, then hosts the Reggae Boyz four days later. In the final games of the regional semifinals, the Americans are at Antigua on Oct. 12 and close Group A at home against Guatemala on Oct. 16.

The top two teams from each of three groups advance to the 2013 regional finals in North and Central America and the Caribbean. The first three teams will qualify for the 2014 tournament in Brazil, and the fourth-place team goes to a home-and-home playoff against the Oceania champion ? likely New Zealand ? for another berth.

Group B has Costa Rica, El Salvador, Guyana and Mexico, and Group C includes Canada, Cuba, Honduras and Panama.

As part of the Americans' preparations for qualifying, U.S. Soccer also announced Wednesday that the Americans will face Scotland in an exhibition May 26 in Jacksonville, Fla. The U.S. also will host Brazil on May 30 in Landover, Md., and play at Canada on June 3.

DALLAS (AP) ? Diane Aulger was about two weeks from her delivery date when she and her husband decided there was no time to wait: Mark Aulger had only days to live, and he wanted to see his child.

Diane Aulger had her labor induced and gave birth to their daughter Jan. 18. When tiny Savannah was placed in his arms, Mark Aulger ?cried, and he just looked very sad,? his wife said. He died five days later from complications related to his cancer treatment.

The 52-year-old Texas man was diagnosed with colon cancer in April. He had surgery and, as a precaution, six months of chemotherapy, Diane Aulger said. With no signs of cancer showing up in follow up tests, the treatment seemed successful.

Then in November, Mark Aulger began having trouble breathing. By Jan. 3, he was sick enough to go to the emergency room. His wife said he was told the chemotherapy had caused him to develop pulmonary fibrosis, which causes scarring and thickening in the lungs.

Initially, the Aulgers were hopeful.

?He thought he?d be coming home in a few days with an oxygen tank,? said Diane Aulger, who lives in The Colony, about 25 miles north of Dallas.

But on Jan. 16, the doctor delivered more bad news: Mark Aulger?s condition was fatal. When Diane Aulger asked how long her husband had, the response was a sobering five or six days.

?Mark said, ?I?d like to see the baby,?? the 31-year-old mother told The Associated Press on Sunday.

Their baby was due Jan. 29, and Diane Aulger had planned a natural childbirth, but when the doctor suggested an induced labor, she immediately agreed. She was already experiencing pre-labor symptoms, and they scheduled the birth for Jan. 18.

Hospital staff arranged for the Aulgers to share a large labor and delivery room.

?Our beds were side by side,? Diane Aulger said.

Mark Aulger held his daughter for about 45 minutes after she was born. For the next couple of days, though, he was so tired he was only able to hold her a couple of times for a minute or so. She said he slipped into a coma on Jan. 21 and died two days later.

?I brought her home the night before he fell into the coma. It was just me and Savannah when he passed away,? Diane Aulger said.

Along with Savannah, the Aulgers have two other children, ages 10 and 7. Diane Aulger also has a 15-year-old and a 13-year-old.

With her family?s story getting much media attention in recent days, Diane Aulger said she?s been heartened by the nice comments she?s received from people.

She plans to blanket her home with pictures of her husband and said her children are already doing a good job of keeping his memory alive by talking about him.

?We?re living day-to-day as if dad?s still here,? she said. ?We know dad is here with us. They talk to dad. Mark was a very funny, funny dad.?

Red Wings match record with 20th straight home win (AP)

DETROIT ? The Detroit Red Wings equaled an NHL record with their 20th straight win at home, beating the Philadelphia Flyers 4-3 Sunday night on the strength of Johan Franzen's tiebreaking goal early in the third period.

The league mark was set by the Boston Bruins during the 1929-30 season and matched by Philadelphia in 1976. Detroit can break the record with a win Tuesday night over the Dallas Stars at Joe Louis Arena.

Philadelphia rookie Brayden Schenn had a career-high two goals, helping the Flyers take the first of two leads they couldn't keep against a team that hasn't lost at home since Nov. 3 against Calgary.

Detroit goalie Joey MacDonald overcame shaky clearing attempts that led to two goals and finished with 26 saves.

Sergei Bobrovsky stopped 21 shots for the Flyers.

Bobrovsky's head was on a swivel in the opening minute of the third period when Henrik Zetterberg and Nicklas Lidstrom made diagonal passes to set up Franzen in front of the net for his 22nd goal.

Bobrovsky got a break moments later when Valtteri Filppula deked him and lifted a shot over the open net.

The Flyers went on the power play midway through the third but couldn't tie the game.

They pulled Bobrovsky with just more than a minute left to add an extra skater, but he had to go back in net briefly when Franzen got to a loose puck and Kimmo Timonen was called for holding him.

Lidstrom played in his 1,550th game, the most by an NHL player who spent his entire career with one team. He broke the mark set by former Red Wings great Alex Delvecchio.

Fans stood and chanted, "Let's go Red Wings!" during the final minutes and cheered wildly when the clock hit zero.

Early on, Philadelphia took advantage of facing MacDonald instead of Jimmy Howard, who missed his fifth straight game with a broken right index finger.

MacDonald misplayed a puck behind the net to help Schenn score late in the first period and couldn't clear a rebound early in the second, setting up Schenn's second goal that put the Flyers ahead 2-1.

Pavel Datsyuk tied it 2-all a few minutes later on a power-play goal from the left circle.

MacDonald didn't have much of a chance to stop Maxime Talbot's go-ahead goal late in the second period. Talbot got behind Detroit's defense and flipped the puck past MacDonald.

Henrik Zetterberg's one-timer a couple of minutes later tied the game at 3 entering the third.

The Red Wings are hoping Howard will return Friday night at home against Nashville.

Fired-up fans at Joe Louis Arena wanted to see a league mark matched and one of them hurled an octopus on the ice during the national anthem, an act usually reserved for a playoff game.

Niklas Kronwall kept them happy, putting Detroit ahead 1-0 midway through the first period with a one-timer from just inside the blue line on a power play. The puck got past Bobrovsky before he could see it because Todd Bertuzzi was obstructing his view, standing in front of the crease.

Schenn was in the perfect spot to score into an open net late in the first period when MacDonald didn't get much wood on a clearing attempt from behind the net, turning it over to Danny Briere, who quickly got the puck to Schenn in front of the net.

Schenn's second goal gave Philadelphia its first lead 5:22 into the second from the bottom of the left circle, beating Zetterberg to a loose puck that was poorly cleared by MacDonald off a rebound.
